DMCA Violation
A DMCA Violation occurs when a copyright holder sends ÃÛÑ¿TV a
complaint or a Cease and Desist notice. ResNet does not monitor your network traffic;
we only respond to complaints of copyright infringement. Under the Digital Millennium
Copyright Act, Resnet, as an Internet Service Provider, is compelled by law to take
action regarding DMCA complaints. ResNet does this by disabling the wired port or
the wireless device, depending on the source of the infringement. Whenever possible,
we will notify you by email that your device or your port has been disabled. In any
case, the port/device will remain disabled until the matter is resolved.
In order to resolve a disabled port due to a DMCA violation, you must remove all offending
content that may have been downloaded, and then bring in the device(s) that may have
caused the complaint to the ResNet office so that we can verify that the content has
been removed. ResNet takes the following step when dealing with DMCA complaints:
- First offense:
- The client must remove all offending content from the device and bring the device
to the ResNet office so that we can verify that the content has been removed. When
removal has been verified, we will begin to reactivate the port. This may take up
to two business days to complete.
- Second offense:
- If a second offense occurs, ResNet will go through the same procedure as the first
offense. In addition ResNet will require the offender to sign a document stating
that a second offense has occurred. After the document is signed ResNet will once
again send up the request for the port or wireless account to be reactivated, network
access may be blocked for a period of up to 30 days.
- Third offense:
- If a third offense occurs, your network access may be revoked permanently. ResNet
will now refer the case to the Dean of students for an academic disciplinary hearing.
At this point you may face civil and criminal penalties as well as academic discipline
which could involve expulsion.
